The purpose of these Terms of Use is to define the terms and conditions for the use of the ComicArtTracker site, hereinafter referred to as 'the Site' and the conditions of use of the Site by the User. Access and use of the Site are subject to your acceptance and compliance of these Terms.

Definitions

Access to the service

The Website is accessible to any adult User with access to the Internet. All costs related to accessing the Service, whether material costs, software or access to the Internet are exclusively the responsibility of the User. Limits of liability

The Site is an aggregation site of various websites offering original comic art for sale (e-commerce websites, auction houses websites, marketplaces and artists' personal websites). Therefore:

Premium accounts and payment processing through Stripe

In order to access certain features of our service, you can upgrade to a premium account. By upgrading to a premium account, you agree to pay the fees associated with the premium account level you have selected, and you consent to our charging your payment method on a recurring basis without requiring your prior approval for each recurring charge, until you notify us of your cancellation. All payments shall be in Euros.

We use a third-party payment processor, Stripe, to process all payments made through our service. By using our service and submitting your payment information, you agree to be bound by Stripe's Terms of Service.

You acknowledge and agree that we are not responsible for any errors or issues that may arise during the payment process, including any errors or issues related to Stripe's payment processing. We are also not responsible for any unauthorized charges or fraudulent activity that may occur as a result of using our service or Stripe's payment processing.

If you believe that there has been an error or unauthorized charge on your account, please contact us immediately via the contact page. We will work with you to resolve any issues as quickly as possible.

We reserve the right to change our fees for premium accounts at any time, and we will provide you with notice of any such changes. If you do not agree to the new fees, you may cancel your premium account at any time.

By upgrading to a premium account, you represent and warrant that all information you provide in connection with the payment process is true, accurate, and complete, and that you have the legal right to use the payment method you have selected.

Intellectual property

The Publisher owns the Site which is provided by means of software, algorithms and databases designed and developed by him and over which he has intellectual property rights.

The primary purpose of the Site is to aggregate data from various merchant sites, marketplaces and auction sites. The content from each of these sites (texts, photos) is the property of the site in question. Each content is clearly associated with a source site and a link to access the original content.

Force majeure

Duration and termination

This contract is concluded for an indefinite period from the use of the Site by the User.

Applicable law and competent jurisdiction

The rules of law, applicable to content and data transmissions on and around the site, are determined by French law. In case of dispute that could not be the subject of an amicable agreement, only the French courts of the jurisdiction of the Court of Appeal of Paris are competent.
